Sirs,

 

In consideration of past experiences from you Shri Milon Banerjee, in the matter of Hindalco, wherein, you represented to the MMTC, in your capacity as the then Additional Solicitor General of India, and you Mr. Gopal Subramanium, from my personal matter, in which you should have moved in Supreme Court for remedy of my fundamental rights, but you had betrayed to protect the interest of the Land Mafia of Kolkata, and you should realize that I never compromises on the principals, even I have suffered a lot of problems.      

                   

Since, 17th May, 2004, I am raising an very important point of law concerning to integrity of the sovereignty and proprietary of the Constitution of India, which was ignored by Smt. Sonia (Soniya) Gandhi and Shri Rahul Gandhi, under their basic object to control the reins of the powers, in spite of the fact that their allegiance to the Constitution of Italy always prevailed irrevocably, unequivocally and undoubtedly, as they cannot renounce their “Absolute Right to Recover Citizenship of Italy”, even if they might have renounced their respective Citizenship of Italy. Whereas, such renouncement does not stand as permanent renouncement, in view of the legal position of Legal Right of “Italian Citizenship by birth” protected under the mandatory provision of Sub-clause (a) of the Clause 1 of Article 1 read with Sub-clause (c) of the Clause 1 of Article 13 of the Citizenship Law of Italy read with Part I under Title I under Article 14(1) and 16(2) under Part I, Title IV, Article 48(3) and 54(1) of the constitution of Italy, since they are always entitled to recover it at any time just within one year from the time of their respective declaration, and without any obstruction from the administration;”

 

With this background on 23rd August, 2006, I submitted an application under RTI Act, 2005, before President’s Secretariat, that on 17th May 2004, at about 10.00 AM (morning), I sent a Fax Message to His Excellency President of India Shri A. P. J. Kalam, referring therein interalia that under the Constitution of Italy, allegiance to the Constitution of Italy of Smt. Sonia Gandhi shall always prevails, and wanted to know that what action was taken by His Excellency Shri A. P. J. Kalam, on my aforesaid representation through Fax Message to see that compliance of the Article 102 of the Constitution of India should be ensured, so one having “Italian Citizen by Birth”, even if he or she might be claiming to be renounced his/her Italian Citizenship, should be disqualified for being chosen as, and for being a member of either House of Parliament under Article 102 of the Constitution of India. Since President’s Secretariat supplied half Information through Memo Letter No. E-6/DPS/20/08/2006 dated Sept. 1, 2006 that “all communications addressed to the President following the 14th General Elections containing various suggestions on the formation of the Government including your letter of 17th May, 2004 were accorded due consideration by the President.”, thus I submitted two supplementary applications: (1) want to know that in view of the aforesaid provision whether His Excellency President of India got examined or contemplating to get examined the legal implication of the fact that though Smt. Sonia Gandhi and Rahul Gandhi might have renounced her/his Italian Citizenship, why ought not to be disqualified for being chosen as, and for being a member of either House of Parliament as debarred by Article 102 of the Constitution of India; and In the context of the aforesaid Reply, (2) I wanted certified copies of all communications in connections with and following the 14th General Elections containing various suggestions including letter forwarded by Smt. Sonia Gandhi, the then newly elected leader of the Congress Party in the Parliament to His Excellency President of India Dr. A. P. J. Kalam claiming formation of the Government headed by herself or by some one else, and reply made by His Excellency to Smt. Sonia Gandhi on or after 16th May 2004, till formation of Government headed by the Prime Minister Dr. Man Mohan Singh.

 

President’s Secretariat during the hearing of the aforesaid Appeals, by the Hon’ble Chief Information Commissioner of the Central Information Commission claimed that they have obtained Opinion from you Shri Milon Banerjee, the Attorney General of India, that correspondence between the His Excellency President of India and Smt. Sonia Gandhi are exempted from disclosure as it covered under ‘Fiduciary Relationship’. If this opinion was given by you, it means you have misused powers and abused the authority of Attorney General of India to protect the private interests of Smt. Sonia Gandhi. Any correspondence made by His Excellency President of India in connection with the formation of the Government after constitution of 14th Loksabha was part of Constitutional Function of His Excellency President and cannot covered under Fiduciary Relationship.

 

I also filed a Writ Petition before Delhi High Court and Bench headed by the then Acting Chief Justice Mr. Vijendra Jain misusing his Judicial Office dismissed the same by committing serious Contempt of the Supreme Court, by taking Judicial Notice of Foreign Law, and it was appearing that in return of the same he was appointed as Chief Justice of Punjab and Haryana High Court. I filed Review Petition, which was also dismissed by the Bench headed by Hon’ble Mr. Justice Swatantra Kumar. Within 15 days from the said Order he was also appointed as Chief Justice of Mumbai High Court. I feel that You Shri Gopal Subramanium was behind such arrangements.

 

To expose the power mongering attitude of Smt. Sonia Gandhi and Shri Rahul Gandhi, which they are maintaining with the full support of the people like you. Therefore, if I may not be killed by political hooligans, I am planning to contest Election against them, to protect the integrity of the sovereignty and proprietary of the Constitution of India.
